The Agency does not own, operate, manage, or control airlines, cruise ships, hotels, resorts, tour operators, transportation companies, or other independent travel suppliers unless expressly stated otherwise in writing.
3. INDEPENDENT TRAVEL SUPPLIERS
The Client understands that many travel services are provided by independent third-party suppliers.
These suppliers may include airlines, cruise lines, hotels, resorts, tour companies, transportation providers, excursion operators, and other travel-related businesses.
Each supplier maintains its own policies, procedures, restrictions, terms of service, cancellation rules, and conditions of carriage.
The Client agrees to review and comply with all applicable supplier terms and conditions.
The Client further acknowledges that the Agency cannot control the actions, omissions, business decisions, operational procedures, or performance of independent suppliers.
To the extent permitted by applicable law, the Agency shall not be responsible for losses, injuries, damages, delays, cancellations, service interruptions, or other consequences caused by independent suppliers or circumstances beyond the Agency's reasonable control.
Nothing in this agreement eliminates liability for the Agency's own negligence, willful misconduct, fraud, or other liability that cannot legally be excluded.
4. RESERVATIONS, BOOKINGS, AND PAYMENT AUTHORIZATION
The Client authorizes the Agency to facilitate travel reservations and purchases on the Client's behalf when expressly requested.
The Client understands that:Travel prices, availability, taxes, and fees may change until a reservation is confirmed and payment is processed.
A quoted price does not guarantee availability or establish a confirmed reservation.
Reservations may require deposits, full payment, or scheduled installment payments.
Failure to make payments by applicable deadlines may result in cancellation, loss of reservations, or financial penalties.
Additional charges may be imposed by suppliers for changes, upgrades, baggage, seat assignments, resort fees, port expenses, or other services.
The Client is responsible for reviewing all booking details before authorizing a purchase.
The Client authorizes the Agency to process payments using the payment method expressly provided and authorized for the applicable transaction.

Refund processing times are controlled in part by the applicable supplier and payment processor.
Supplier credits, vouchers, or future travel credits may be subject to expiration dates and restrictions.
All cancellation requests must be submitted to the Agency in writing through its designated email or communication channel.
The Agency will communicate applicable supplier policies and assist with eligible cancellation or refund requests.
The Agency does not guarantee that a supplier will approve a refund, credit, or exception.
However, nothing in this agreement waives any refund or other consumer rights required by applicable federal or state law.

Airline reservations are subject to the applicable airline's conditions of carriage, ticket restrictions, baggage policies, check-in requirements, and operational procedures.
The Client is responsible for:Verifying passenger names against government-issued identification and travel documents.

The Agency does not operate or control cruise ships and is not responsible for independent cruise line decisions or onboard operations.
To the extent permitted by law, claims involving cruise transportation may be governed by maritime law, federal law, and the cruise line's passenger ticket contract, including specific notice requirements, filing deadlines, and designated legal forums.

The Client is responsible for determining whether they are physically and medically capable of participating in their selected travel arrangements and activities.
The Client should consult an appropriate healthcare professional when necessary before travel.
The Client understands that international destinations, remote locations, cruise ships, and certain excursions may have limited access to medical care.
The Client is responsible for disclosing any information required by a supplier to determine eligibility for travel or participation in an activity.
The Agency does not provide medical advice or guarantee the availability of medical treatment, emergency evacuation, or medical facilities during travel.

Lost, stolen, or delayed baggage.
Certain unexpected travel emergencies.
The Client understands that travel insurance is governed by the insurance company's policy terms, exclusions, limitations, and eligibility requirements.
The Agency does not guarantee that any particular insurance policy will cover a specific loss or event.
Unless separately licensed and authorized to do so, the Agency does not act as an insurance company or provide insurance underwriting services.
The Client is responsible for reviewing the actual policy and determining whether the selected coverage meets their needs.
Declining travel insurance does not transfer responsibility for uninsured losses to the Agency.

The Client is responsible for reviewing booking confirmations and travel documents promptly after receiving them.

The Agency may charge consultation fees, planning fees, booking fees, administrative fees, change fees, or other disclosed service charges.
Any applicable Agency fees will be communicated to the Client before the Client becomes obligated to pay them.
Agency service fees are separate from amounts charged by airlines, hotels, cruise lines, tour operators, insurance providers, and other suppliers.
Whether an Agency fee is refundable will be disclosed before payment and will remain subject to applicable law.
16. LIMITATION OF AGENCY LIABILITY
The Agency acts as an intermediary or travel service provider in arranging travel services with independent suppliers.
To the maximum extent permitted by applicable law, the Agency shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from services provided by independent travel suppliers or circumstances outside the Agency's reasonable control.

The Agency's responsibilities are limited to the services it expressly agrees to provide under the applicable booking or service arrangement.
17. INDEMNIFICATION
To the extent permitted by law, the Client agrees to be responsible for losses, claims, damages, or expenses arising from the Client's own unlawful conduct, intentional misconduct, or material violation of applicable supplier requirements.
The Client shall not be required to indemnify the Agency for claims resulting from the Agency's own negligence, gross negligence, willful misconduct, fraud, or other conduct for which indemnification is prohibited by applicable law.
18. DISPUTES AND GOVERNING LAW
This agreement shall be governed by the laws of the State of Texas, without regard to its conflict-of-law principles, except where applicable federal law or mandatory law of another jurisdiction controls.
The parties agree to make a good-faith effort to resolve disputes through direct communication before pursuing formal legal proceedings.
Any legal proceeding shall be brought in a court of competent jurisdiction, subject to applicable jurisdictional requirements, mandatory consumer protections, and any controlling federal or maritime law.
Nothing in this agreement prevents a Client from exercising rights available under applicable consumer protection laws or filing a complaint with an appropriate government agency.

The Agency may maintain an electronic record of the Client's acceptance, including the date, time, agreement version, and other available transaction records.
This provision is intended to operate consistently with the Texas Uniform Electronic Transactions Act and other applicable electronic signature laws.

Any unenforceable provision shall be interpreted or limited only to the extent necessary to make it enforceable, where legally permissible.
22. ENTIRE AGREEMENT
These Terms and Conditions, together with any applicable written booking confirmations, service agreements, supplier terms, and separately accepted disclosures, constitute the agreement between the Agency and the Client concerning the services covered by those documents.
